John M. Mooney, Jr., PLLC

John M. Mooney, Jr. is an attorney with the Law Offices of John M. Mooney, Jr., PLLC in Madison, Mississippi. Mr. Mooney practices in the areas of labor and employment, insurance law, Indian law, constitutional law and civil litigation. Mr. Mooney has extensive experience in handling of cases before the U.S. Equal Employment Opportunity Commission and litigating cases in both federal and state court involving civil rights and constitutional violations, and discrimination and retaliation in the workplace.  

Mr. Mooney has published in the areas of employment law, civil litigation and discovery, copyright and trademark infringement, and he has served as seminar speaker throughout his legal career in the areas of discovery, employment law, constitutional rights and the Federal Rules of Civil Procedure.

Mr. Mooney represented the employee in the seminal case on retaliatory or wrongful discharge in Mississippi, Kelly v. Mississippi Valley Gas, decided by the Mississippi Supreme Court in 1981. He has obtained substantial settlements and jury verdicts in labor and employment cases in both state and federal court. 

Mr. Mooney represents Mississippi state service employees before the Mississippi Employee Appeals Board; and he also represents employees in civil litigation under the Fair Labor Standards Act and he has represented Administrators in both Federal and State Court in Mississippi; and he has experience in cases involving the Federal Fair Housing Act and the Rehabilitation Act.     

Mr. Mooney has also represented federal employees before the United States Merit Systems Protection Board; and he has extensive experience in the handling of Indian law cases and in particular representing members of the Mississippi Band of Choctaw Indians before the Tribal Court and Choctaw Supreme Court.   

Mr. Mooney is a member of the American Bar Association, Mississippi Bar (Labor and Employment Law and Civil Litigation Sections).  Mr. Mooney is a member of the National Employment Lawyers Association.  Mr. Mooney is also the past president of the Hinds County Trial Lawyers Association.    

Mr. Mooney has served as a judge in Mock Trial competition sponsored by the Mississippi Bar; and he has served as a Guest Columnist for Mississippi’s largest newspaper the Clarion Ledger having written articles on various subjects, including constitutional law and the decisions of the United States Supreme Court.      

Mr. Mooney obtained his B.A. degree from the University of Southern Mississippi and his J.D. Degree from Mississippi College School of Law. Mr. Mooney is a past president of the student body of the Mississippi College School of Law.

Mr. Mooney was admitted to the Mississippi State Bar in 1977 and he is admitted to practice before the Tribal Court and Supreme Court of the Mississippi Band of Choctaw Indians.  In Mississippi Mr. Mooney is admitted to practice before the United States District Courts in Mississippi, Northern and Southern Districts; Fifth Circuit Court of Appeals; Federal Circuit Court of Appeals and the United States Supreme Court.
